By installing or using DKSpoonVault ("the app") you agree to these Terms. If you do not agree, do not use the app.
You must be at least 18 years old to use the app. The optional cloud AI feature additionally requires your own Anthropic account and API key, and Anthropic requires its users to be 18 or older.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for cataloging your own spoon collection, subject to these Terms and Google Play's terms.
Cloud classification uses Anthropic's Claude models to suggest a place and tags from a photo. Suggestions may be wrong, incomplete, or out of date. They are starting points you review and edit; do not rely on them as factual, and verify anything important. AI output is presented for your review and is not committed without your action.
The app is a one-time paid purchase through Google Play. All sales, billing, and refunds are handled by Google Play under Google Play's terms and refund policy; we do not process or store your payment information.
The optional cloud AI feature uses your own Anthropic API key, which you enter in the app. You are solely responsible for (a) keeping your key secure and (b) all charges Anthropic bills to your account for usage you initiate. We do not control, set, or receive those charges. Your use of Anthropic is governed by Anthropic's Commercial Terms and Acceptable Use Policy.
The app relies on third-party services and components, including Anthropic (Claude API), OpenStreetMap / the map tile provider, and Google ML Kit. Your use of those is also subject to their terms. Map data © OpenStreetMap contributors.
You agree not to: upload images you do not have the right to use; use the AI feature to identify, profile, or infer information about real people; violate Anthropic's Acceptable Use Policy; or misuse, reverse-engineer, or disrupt the app except as permitted by law.
Your photos and catalog are yours and are stored on your device. You are responsible for your own backups (the app provides an export/restore feature). We have no server and keep no copy of your content.
The app and its original content are owned by us or our licensors. Open-source components are provided under their respective licenses (see the in-app open-source notices / the repository).
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY THIRD-PARTY CHARGES (INCLUDING ANTHROPIC API CHARGES), LOST DATA, OR LOST PROFITS. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM (OR USD $0 IF THE APP WAS FREE).
You agree to indemnify us against claims arising from your misuse of the app, your content, or your violation of these Terms or any third-party terms (including Anthropic's).
We may update these Terms (the "Effective date" will change). We may suspend or stop the app. If any provision is unenforceable, the rest remains in effect.
These Terms are governed by the laws of the State of North Dakota, United States, without regard to conflict-of-laws rules.
